What is Elder Law?
Elder law is a broad term focuses on the rights and legal issues that are of most concern for older Australians. It’s all about providing these important members of our community with the respect and dignity that they deserve.
Although not exclusive elder law may involve:
Disputes about capacity and ability to manage affairs;
Health care issues and implementing appropriate support;
Retirement villages and nursing home agreements;
Elder abuse and vulnerability.
Guardianship Disputes and NCAT Applications
We know that deeply emotional family disputes can arise in relation to the financial and care arrangements for our loved ones.
In these circumstances we can assist to resolve the conflict and where necessary assist with applications to have the matter decided by the NSW Civil and Administrative Tribunal (NCAT).
Common applications to the NSW Civil and Administrative Tribunal include:
Guardianship Orders;
Financial Management Orders;
Consent for Medical or Dental Procedures (where unable to give their own consent);
Review of existing Power or Attorney or Enduring Guardianship arrangement.
Often these disputes arise when an elderly parent begins to need additional support and tensions arise in relation to where they should live or who is the most appropriate person to provide assistance.
At Abbotts and Co we believe the best way to ensure that you have your own say in your future care and financial arrangements is to put a power of attorney and enduring guardianship in place while you have the ability to do so.
